How is it a TV licence is required for a video recorder yet you can catch up via BBC’s iPlayer without needing a licence?

What is a “near live” broadcast? - is a TV licence required if a broadcast is timeshifted by two minutes? - how about twenty minutes? Unsurprisingly, “near live” is ill-defined.
